MODESTO ROADSTERS TICKET TERMS AND CONDITIONS
Effective Date: 3/25/2026
These Ticket Terms and Conditions, together with any applicable ballpark policies, health and safety policies, and posted instructions, govern admission to any Modesto Roadsters game, event, or other activity for which a ticket is issued. By purchasing, accepting, using, or holding a ticket, the ticket holder agrees to these terms on behalf of themselves and any minor or other person for whom they hold a ticket.
1. Revocable License
Each ticket is a revocable license issued by Main Street Modesto, LLC, doing business as the Modesto Roadsters, and permits entry only to the event identified on the ticket, subject to these Terms and Conditions. This license may be revoked at any time, with or without cause, in the sole discretion of the Club, with or without refund to the extent permitted by applicable law.
A ticket does not confer any property right. Admission may be refused or withdrawn for failure to comply with these Terms and Conditions, ballpark policies, or instructions of Club personnel, security, or law enforcement.
Unless expressly stated otherwise by the Club, no re-entry is permitted after exit from the ballpark.
2. Agreement by Holder and Accompanying Parties
By purchasing, accepting, using, or holding a ticket, the ticket holder agrees to these Terms and Conditions on behalf of:
- themselves,
- any minor accompanying them or attending under their supervision, and
- any other person for whom the holder purchased, accepted, or retains a ticket.
For purposes of these Terms and Conditions, all such persons are collectively referred to as the “Holder.”
If the ticket holder is not authorized to accept these Terms and Conditions on behalf of any accompanying person, that person must not enter or remain in the ballpark.
3. Assumption of Risk
Holder acknowledges and understands that attendance at a baseball game or other event at the ballpark involves inherent risks, hazards, and dangers, both known and unknown, that may result in personal injury, illness, death, or property damage.
These risks include, without limitation:
- thrown, batted, or broken bats, balls, and other objects,
- slips, trips, and falls,
- collisions with other spectators or participants,
- crowd-related incidents,
- acts or omissions of other spectators, vendors, or third parties,
- exposure to weather conditions,
- exposure to viruses, bacteria, or other communicable diseases, including COVID-19, and
- any other hazards associated with attending a live sporting event or public gathering.
Holder voluntarily assumes all risks, hazards, and dangers arising from or relating in any way to attendance at, participation in, entry to, or presence at the event or ballpark, whether occurring before, during, or after the event.
4. Health and Safety Compliance
Holder agrees to comply with all health, safety, security, and ballpark policies established by the Modesto Roadsters, the owner or operator of the ballpark, and applicable governmental authorities.
Holder acknowledges that such policies may be modified at any time and may include screening, bag inspection, security checks, restrictions on items brought into the ballpark, seating relocations, and other measures deemed necessary for safety or operations.
Holder consents to reasonable security screening, including inspection of bags, clothing, or personal items, as a condition of entry. Refusal to comply may result in denial of entry or ejection without refund.
5. Conduct and Ejection
Holder must conduct themselves in a lawful, safe, and respectful manner at all times. Without limitation, the Club reserves the right to deny admission, revoke this license, eject any person, and/or take other action, without refund, if the Holder:
- violates these Terms and Conditions,
- violates any posted ballpark rule or policy,
- appears intoxicated or impaired,
- engages in disorderly, disruptive, abusive, threatening, or unlawful conduct,
- uses vulgar, obscene, or abusive language or gestures,
- interferes with the event or other spectators’ enjoyment,
- poses a health or safety risk, as determined by the Club in its sole discretion, or
- fails to follow the instructions of Club personnel, security, or law enforcement.
The Club’s decisions regarding ballpark access, conduct, safety, and ejection are final.
6. Media, Recording, and Transmission Restrictions
Holder may not, without the express written consent of the Club and any other required rights holder, transmit, distribute, publish, record for commercial use, livestream, or otherwise exploit any account, description, picture, video, audio, reproduction, or other information or content concerning the event, including any play-by-play, statistics, game action, or other data, in any media now known or later developed.
The Club reserves the right to revoke admission or take any other action permitted by law for violation of these restrictions.
Personal, non-commercial photographs or video taken for private use may be permitted only to the extent allowed by Club policy and applicable law, and may not be used for commercial purposes, broadcast, livestreaming, or other unauthorized distribution.
7. Likeness Release
By entering the ballpark, Holder grants to the Club, the league, the ballpark owner or operator, sponsors, licensees, designees, broadcasters, and each of their respective affiliates, agents, and assigns, the irrevocable right and license to use, reproduce, distribute, display, broadcast, publish, and otherwise exploit Holder’s name, image, likeness, voice, appearance, actions, and statements, live or recorded, in any medium, throughout the world, in perpetuity, for any lawful purpose, including advertising, promotion, publicity, editorial, archival, and commercial purposes, without further notice, approval, or compensation.
8. Release of Liability and Hold Harmless
To the fullest extent permitted by law, Holder, for themselves and for their heirs, assigns, executors, administrators, next of kin, and anyone else who may claim on their behalf, releases and agrees to hold harmless:
- Main Street Modesto, LLC, doing business as the Modesto Roadsters,
- the City of Modesto,
- the ballpark owner and operator,
- the applicable league,
- ticketing providers,
- sponsors,
- vendors,
- concessionaires,
- contractors,
- players,
- managers,
- coaches,
- employees,
- officers,
- directors,
- owners,
- members,
- partners,
- agents,
- representatives,
- affiliates,
- successors, and assigns,
from and against any and all claims, demands, causes of action, damages, losses, liabilities, costs, and expenses of any kind, whether known or unknown, arising out of or relating in any way to the Holder’s attendance at, travel to or from, presence at, or participation in the event or entry into the ballpark, including claims arising from personal injury, illness, death, or property damage.
This release applies to the fullest extent permitted by law, including claims alleging negligence by any released party, except to the extent prohibited by applicable law.
9. Indemnification
Holder agrees to indemnify, defend, and hold harmless the released parties from and against any claim, liability, loss, damage, or expense, including reasonable attorneys’ fees and costs, arising out of or relating to:
- Holder’s violation of these Terms and Conditions,
- Holder’s conduct at the event or ballpark,
- Holder’s violation of any law or the rights of any person or entity, or
- any claim brought by or on behalf of an accompanying party, including a minor, arising from Holder’s acts, omissions, or failure to comply with these Terms and Conditions.
10. Event Date, Time, Opponent, and Promotional Elements Subject to Change
All event dates, times, opponents, rosters, promotional activities, giveaways, entertainment features, and other event elements are subject to change. The Club is not responsible for, and no refund or exchange will be required solely because of, changes to players, lineups, opponents, game times, promotional items, or entertainment features, unless otherwise expressly determined by the Club.
11. Postponement, Suspension, Cancellation, and Rain Policy
If a game or event is postponed, suspended, interrupted, shortened, or canceled for weather, field conditions, emergency, technical issues, public safety concerns, force majeure, governmental action, or any other reason, this ticket may be honored for the rescheduled or resumed event, exchanged for another event, or deemed of no value, in each case as determined by the Club in its sole discretion and subject to applicable law.
Any refund, credit, exchange, rain check, or replacement policy shall be governed exclusively by the Club’s then-current policy for the applicable event. Promotional value, service fees, processing charges, and incidental expenses may be excluded from any refund or credit to the extent permitted by law.
12. Ballpark Policies
All admissions are subject to the Club’s then-current ballpark policies, including policies regarding:
- prohibited items,
- bags and inspections,
- fan conduct,
- smoking or vaping,
- alcohol sales and consumption,
- seating access,
- children,
- strollers,
- cameras and recording devices,
- accessible seating,
- parking, and
- emergency procedures.
Such policies may be posted at the ballpark or on the Club website and are incorporated into these Terms and Conditions by reference.
13. Ticket Resale and Transfer
Tickets may not be used in violation of any applicable law or Club policy regarding resale, transfer, or promotional use. The Club reserves the right to cancel, revoke, or refuse admission on any ticket that has been resold or transferred in violation of law or Club policy.
The Club is not responsible for tickets obtained from unauthorized sources and makes no representation regarding the authenticity of tickets not purchased through approved channels.
14. Mobile, Printed, Complimentary, and Promotional Tickets
These Terms and Conditions apply to all tickets, including printed tickets, mobile tickets, complimentary tickets, credentialed admissions, and promotional admissions, except to the extent the Club expressly provides otherwise in writing.
15. Mandatory Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS.
To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating in any way to:
- the ticket,
- these Terms and Conditions,
- attendance at or exclusion from the event,
- presence at the ballpark,
- any injury, illness, death, or property damage allegedly suffered in connection with the event or ballpark, or
- the interpretation, applicability, enforceability, or formation of this arbitration provision,
shall be resolved exclusively through final and binding individual arbitration, and not in court, except for claims that may be brought in small claims court if eligible.
Holder and the Club each waive any right to a jury trial.
Holder and the Club further agree that any arbitration shall be conducted only on an individual basis and not as a class, collective, consolidated, representative, or private attorney general action.
Holder may not join, consolidate, or bring claims on behalf of others, and the arbitrator shall have no authority to hear or arbitrate any class, representative, collective, or private attorney general claim.
If any portion of this class action waiver is found unenforceable, then the class, collective, consolidated, representative, or private attorney general claim must be resolved in a court of competent jurisdiction, and the remaining claims shall be arbitrated to the fullest extent permitted by law.
The arbitration shall be administered by a nationally recognized arbitration provider selected by the Club, under the provider’s applicable consumer arbitration rules then in effect, except as modified by these Terms and Conditions. The arbitration shall take place in Stanislaus County, California, unless the parties agree otherwise or applicable law requires a different location or format.
The arbitrator shall have exclusive authority to resolve all disputes regarding the interpretation, applicability, enforceability, and formation of this arbitration agreement, except that a court of competent jurisdiction shall decide any dispute regarding the enforceability of the class action waiver.
16. Governing Law and Venue
Except to the extent preempted by federal law or governed by the arbitration provisions above, these Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of laws principles.
For any matter not subject to arbitration, exclusive venue shall lie in the state or federal courts located in California, and the parties consent to personal jurisdiction in such courts.
17. Severability
If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the fullest extent permitted by law.
18. No Waiver
Failure of the Club to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision or any other provision.
19. Changes to Terms
The Club may update or modify these Terms and Conditions at any time. The version posted on this page as of the date the ticket is purchased or used, as applicable and as permitted by law, shall govern.
